Our firm’s victory in Atalese v. U.S. Legal Services Group, L.P.-a case that sent shock-waves through the business and legal communities-is now cemented as the law of the land in New Jersey. After the unanimous win for New Jersey consumers in our State Supreme Court, the defendants, with the assistance of major corporate interest groups, asked the United States Supreme Court to hear and overturn the New Jersey Case.
On June 4, 2015, when the U.S. Supreme Court considered the petition, they determined that they would not hear the case. As a result, the rule set down in Atalese will remain the law in New Jersey for the foreseeable future: a business cannot force you to give up your constitutional rights without telling you what you are giving up.
